Terms and Conditions of Raffle (Denver): Promotion: The Metro Express Car Wash - Colorado is administered by Bluebird Car Wash Management, LLC. The promotion will grant one winner a 65’ TV. Eligibility: Each Member of a Metro Express Car Wash - Colorado as of January 31, 2024. One ticket will be awarded to every person or entity that is a Member as of January 31, 2024. Members will also be eligible to purchase additional tickets for $5.00 each. Additional tickets will be available for purchase between January 1, 2024 and January 31, 2024 at Metro Express Car Wash - Colorado. Prize: 65’ TV Winner Selection: The raffle will end January 31, 2024 and the winning ticket will be randomly selected the first week of February. The Member with the winning ticket will be immediately notified and must claim the prize within five days of notification. Only one winner will be selected. The potential winner will be notified by email and phone. The potential winner will forfeit the Prize if the Member has been picked up the Prize within five days after notification. In that event another winning ticket will be randomly selected. General Conditions of Raffle: Must be an Active Member of the business as of January 31, 2024 and at the time of claiming the Prize. The Promotion runs from January 1, 2024 through the end of the business day on January 31, 2024. The winner must have a valid raffle entry (Active membership or Active membership with additional entry purchased at a Metro Express Car Wash – Colorado). Any winner is subject to verification by Bluebird Car Wash Management, LLC, whose decisions are final and binding in all matters related to the Promotion. By entering the Promotion entrants agree to release Bluebird Car Wash Management, LLC and Metro Express Car Wash - Colorado from any liability whatsoever for claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or with acceptance, possession, attendance at or use of any Prize. Bluebird Car Wash Management, LLC does not guarantee the Prize and the winner must look to the manufacturer of the Prize for an warranty, if any. Entrants also agree to be contacted with marketing information and promotional material. Disputes: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court located in Ada County, Idaho; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant claims all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
